About Infringement Remedies

At Tony Brands, we take copyright infringement seriously and are committed to protecting our creator intellectual property. If our creator’s work is used without permission, we reserve the right to pursue the following remedies:

Monetary Damages

Any unauthorized use of our intellectual properties that results in financial harm or loss, we will pursue compensation, which may include:

• Actual Damages: Recovering losses resulting from the infringement, such as lost revenue or licensing fees.

• Statutory Damages: Seeking compensation as prescribed by law, which can range from $750 to $30,000 per infringement, or up to $150,000 for willful infringement.

• Infringer’s Profits: We may seek to recover any profits made by the infringer that were derived from the unauthorized use of our intellectual properties.

Infringement Remedies Information

The Infringer acknowledges that they have used, reproduced, distributed, or otherwise exploited copyrighted material owned by the Owner without permission, in violation of applicable copyright laws.

Confidentiality

Both parties agree to keep the terms of this Agreement confidential and not disclose them to any third parties, except where required by law.

Payment Terms

The Infringer agrees to make full payment within [X] days from the date of infringement notice. Payment will be made via through Tony Brands to the designated by the fund to pay our creator partners.
